Tesla (TSLA) Stock News: Appeals Court Vacates Full Self-Driving Class Certification

A Ninth Circuit panel vacated class certification on October 16, 2026 in the long-running consumer case over how Tesla marketed its driver-assistance packages, according to OpenClassActions. The case, In re Tesla Advanced Driver Assistance Systems Litigation (No. 3:22-cv-05240, Northern District of California), goes back to Judge Rita F. Lin.
What the appeals court decided
In August 2025 Judge Lin certified two California classes of buyers who paid separately for Full Self-Driving. Tesla appealed. In an unpublished memorandum in LoSavio v. Tesla, the panel held the district court erred by inferring that every class member saw Tesla’s statement that its cars had the hardware needed for full self-driving, because that statement appeared on a webpage buyers were not required to visit. Without presumed exposure, individual questions could predominate.
What it does not decide
Class certification is procedural. The ruling does not find Tesla’s marketing truthful or misleading, and the plaintiffs can try again with a narrower theory. Tesla denies the claims. There is no settlement and nothing to claim.
Why it matters for the stock
For readers following TSLA, the decision lowers the near-term risk of a large consumer class judgment over FSD marketing, which had been a live overhang since 2022. Regulatory reviews of the software are separate and unaffected.
