Delta Air Lines’ $78.75 million settlement over the January 14, 2020 fuel jettison by Flight DL89 is nearing final approval after a tentative ruling on September 28, 2026, according to OpenClassActions.

The case

After departing Los Angeles International Airport, DL89 jettisoned fuel during an in-flight emergency. Property owners and residents in a court-defined area alleged fuel reached homes and outdoor spaces. Delta denied wrongdoing and agreed to settle.

How the fund is divided

The notice estimated a net fund of about $50.59 million after court-approved deductions, allocated 67% to qualifying property owners, divided per property, and 33% to qualifying residents, divided equally among verified claims. Claimants had to identify an affected property and verify ownership or residency on the date. The claim deadline was February 6, 2026 and has passed.

Why it matters for the stock

For readers following DAL, the amount is small for an airline of Delta’s size and the event is nearly seven years old; any reserve was taken long ago. The case is mostly a reminder that operational incidents can carry litigation tails measured in years.
