Claims are open in a $15 million settlement of Delaware stockholder litigation over the 2021 merger between Atlas Crest Investment Corp., a special purpose acquisition company, and Archer Aviation, according to OpenClassActions. The Court of Chancery has set the settlement hearing for December 3, 2026.

The claim

Atlas Crest raised $500 million in October 2020 and agreed to merge with Archer in February 2021. Like other SPAC cases, the suit concerned the information public stockholders had when deciding whether to redeem shares for $10 or stay invested in the combined company. The settling defendants are five individuals, Kenneth Moelis, Michael Spellacy, Emanuel Pearlman, David Fox and Eileen Murray, who deny wrongdoing. The parties reached the deal after a June 2026 mediation.

How to file

Proofs of claim must be submitted online or received by mail by January 4, 2027, with brokerage statements or confirmations for Atlas Crest and Archer shares. Payments are pro rata based on shares held or sold, with a $10 minimum, and go out only after court approval.

Why it matters for the stock

For readers following ACHR, the company is not paying; the settlement is funded by former SPAC directors. The case is part of a broad wave of Delaware SPAC litigation and does not bear on Archer’s aircraft certification timeline, which remains the operating question.
